Andhra Pradesh has banned online gaming, online betting and gambling, and has urged the Centre to direct all internet service providers to block access to 132 websites and apps, including Paytm The Law Commission of India released its report entitled ‘Legal Framework: Gambling and Sports Betting Including in Cricket in India’ (“Report”) on July 5, 2018. A day after releasing the Report, the Commission released a press note stressing that its recommendation was to ban betting and gambling in India. Is gambling banned in India? Yes, it is. The Public Gambling Act of 1867 bans gambling in India. However, that is not the end of the story. There are some exceptions to this rule. Horse Racing and Rummy are legal in India and you can bet on them without any trouble. Similarly, fantasy-based games such as Dream11 and others are ruled to be games of skill rather than games of chance and so they are legal as well. The primary legislative document that makes gambling in India a ‘grey’ legality is the Public Gambling Act. This is an old law created during British rule. This 145-year-old law makes operating a gambling house, assisting in the operation of a gambling house, visiting a gambling house (whether gambling or not), financing gambling and being The Public Gambling Act of 1867 prevents casinos and gambling houses from operating in India. If a company or a business if found violating this law, they will be subject to a fine of ₹200 or go to prison for a period of 3 months. The law is also applicable to players who visit these illegal gambling establishments. Gambling with credit cards to be banned for online betting; with every state in India having its own legislation on gambling, and most states having an exemption for games of skill. While Online Gaming/Gambling laws in India prohibit betting or wagering and any act which is intended to aid or facilitate the same. Gaming/Gambling being a State subject, gaming/gambling in India have laws which differ from state to state . This would mean what is permitted in one State may be an offence in another. Online Gambling Banned in India’s Andhra Pradesh: The Andhra Pradesh Gaming Act 1974 has been amended to ban online gambling games like online Rummy and Poker. The AP Cabinet today approved the amendment. As per the amendment, a person found playing these online gambling games will be punished with six months imprisonment. The Chief Minister YS Jagan Mohan Reddy together with the Council of Ministers has approved the amendments to the Gaming Act from 1974 introducing changes towards online gaming, particularly targeting to prevent people playing games such as rummy and poker. Casino gambling and playing poker are popular pastimes as well. Despite the popularity of gambling in India, it’s technically prohibited in most of its forms. There are some exceptions, but there is very little in the way of legalized and regulated gambling. Much of the legislation which relates to gambling is very outdated and decidedly unclear.
